Keep audio controls in tab context menu after tab has played audio

seems that vlad said that the implementation would be just like safari: https://orionfeedback.org/d/5580-remove-mute-this-tab-tab-context-menu-item-when-tab-isnt-playing-audio/9
but it isn't currently working.
once tab stops playing audio, right click -> mute tab option disappears.
Possible that it was just never implemented that way. It isn't really necessary as there alway is Window->Mute Tab
